Description

A ski instructor is someone who professionally teaches, even on a non-exclusive and non-continuous basis, individuals and groups the skiing techniques in all their specializations, practiced with any type of equipment on ski slopes, ski routes, off-piste ski routes, and ski tours that do not involve difficulties requiring the use of mountaineering techniques and materials such as rope, ice axe, and crampons.

Pursuant to Legislative Decree 206/2007 implementing Directive 2005/36/CE, the free provision of services may be carried out in Italy on a temporary and occasional basis within the framework of the free provision of services by a citizen legally established in another EU/EEA State (Iceland, Liechtenstein, and Norway) or in Switzerland, where they practice the same profession.

One is legally established in a State when all requirements for practicing the profession in that State are met and one is not subject to any prohibition, not even temporary, from practicing the profession itself.

Before carrying out the activity of a ski instructor in the Autonomous Province of Bolzano-South Tyrol, a prior notification must be sent to the competent provincial office (Area funzionale Turismo), attaching the documentation required by Directive 2005/36/CE.

For data protection reasons, prior notification must be provided by the person directly concerned, i.e. the ski instructors themselves.

The temporary and occasional activity of a ski instructor can be carried out in the Autonomous Province of Bolzano-South Tyrol for a maximum of 50 days per winter season – the prior notification must be renewed annually.

Who is the service aimed at?

Pursuant to Legislative Decree 206/2007 implementing Directive 2005/36/CE, the free provision of services may be carried out in Italy on a temporary and occasional basis within the framework of the free provision of services by a citizen legally established in another EU/EEA State (Iceland, Liechtenstein, and Norway) or in Switzerland, where they practice the same profession.

One is legally established in a State when all requirements for practicing the profession in that State are met and one is not subject to any prohibition, not even temporary, from practicing the profession itself.


Requirements

The requirements relate to your professional qualifications and the country in which you obtained them.
  • You must have obtained your professional qualification as a ski instructor in an EU or EEA member state or in Svitzerland;
  • You must be authorized to work as a ski instructor during the respective winter season in your country of origin (EU, EEA, or Switzerland), either independently or within a ski school;
  • You must submit prior notification to the competent authority before you start working;
  • The temporary activity may be carried out for a maximum of 50 days per winter season and must be renewed annually.

What is needed

The documents to be attached to the prior notification of temporary and occasional pursuit of the profession of ski instructor vary depending on whether the profession of ski instructor is regulated in the country where the professional is legally established:

DOCUMENTS TO BE ATTACHED IF THE PROFESSION IS REGULATED IN THE STATE OF ESTABLISHMENT (FOR EXAMPLE IN AUSTRIA, CROATIA, GERMANY, SLOVENIA)

  1. Front and back of a valid identity card;
  2. Certificate from the competent authority for the season in question, stating that the holder is legally established as a ski instructor in the Member State of origin and that he is not prohibited from working as a ski instructor at the time of issue of the certificate;
  3. Copy of the front and back of the ski instructor ID card valid for the season in question, with the relevant annual stamps;
  4. Certificate of passing the technical examination (Euro Test) in accordance with Delegated Regulation (EU) 2019/907 (Euro Test), see note;
  5. Copy of the qualification certificate (ski instructor diploma);
  6. Copy of the insurance policy – proof of professional liability insurance valid in Italy for the profession of ski instructor with a sum insured of at least €6.000.000.00;

DOCUMENTS TO BE ATTACHED IF THE PROFESSION IS NOT REGULATED IN THE COUNTRY OF ESTABLISHMENT (E.G. IN BELGIUM, FINLAND, NORWAY, POLAND)

  1. Front and back of a valid identity card;
  2. International version of a criminal record extract / extract from the criminal record (maximum validity 12 months from date of issue);
  3. Copy of the front and back of the ski instructor's license valid for the season in question with the corresponding annual stamps;
  4. Certificate of passing the technical examination (Euro Test) in accordance with Delegated Regulation (EU) 2019/907 (Euro Test), see note;
  5. Copy of the qualification certificate (ski instructor diploma);
  6. Copy of the insurance policy – proof of professional liability insurance valid in Italy for the profession of ski instructor with a sum insured of at least €6.000.000,00;
  7. Declaration with detailed documentation (days per year with certificate of employment) proving that the profession was actually practiced for at least one year (12 months) in the ten years prior to the prior notification (Directive 2005/36/EC).

NOTE

4 Certificate of passing the technical examination (Euro Test): This examination is only required if the occasional temporary activity as a ski instructor is carried out outside a South Tyrolean ski school and the service provider does not benefit from the acquired rights pursuant to Article 7 of Delegated Regulation (EU) 2019/907.

How to apply

Prior notification must be given exclusively via the online service of the Autonomous Province of Bolzano-South Tyrol, which is available at the following address:

Registration and sending of prior notifications:
Register on the tourism-temporary-professions.civis.bz.it page, fill out the notification form, upload all the required documents, sign the notification and then click on "SEND".

Integration of prior notifications:
If, after sending your notification, you have received a letter from the Area funzionale Turismo informing you that documents are still missing or need to be integrated, you must complete the required integration directly through the Platform.

You have 30 days to do so.

To do this, log in to your personal area on the tourism-temporary-professions.civis.bz.it page, click on the number of the mentioned notification and complete your documents directly on the platform by uploading the previously mentioned or missing documents. Then click on "SEND". Only then is your integration complete and can be checked by the Area funzionale Turismo.

In the event of a positive review, we will take note of your prior notification. Otherwise, your notification must be rejected.

Check the status of your prior notification always on the platform; In addition to this, you we will be informed via email.

 


What follows

The office will review and process your notification as quickly as possible.

Depending on the volume and current workload, this may take some time, but no longer than 30 days from receipt of the complete documents.

Under certain circumstances, it may be necessary to involve other agencies, such as the European Commission's Internal Market Information System (IMI).

If any documents are missing, incomplete or do not match, the office will contact you by email so that you can complete your documents within 30 days via the online service. The ‘Integration’ function is available for this purpose in your personal area. If you do not submit the requested documents within this period, or if they are incomplete, your early notification will be processed based on the documents available.

A summary of your notification is available for download in your personal area. You should always carry this summary with you when you are working as a temporary ski instructor in South Tyrol, either in digital or printed form.


Timings and deadlines

From the date of receipt of your prior notification with all the mandatory documents, the waiting period is a maximum of 30 days until:

  1. the submitted documents have been checked, and the competent provincial authority (Area funzionale Turismo) has responded to you on the platform and by email;
  2. or the competent provincial authority (Area funzionale Turismo) has asked you to supplement the documents via the platform and has sent you an email requesting additional information.
